Terms and Conditions

IMPORTANT INFORMATION:

  • Free Trial: If you are on a free trial you will be charged $29.95 per month (or stated price if coupons or deals are applied) when your trail ends unless you choose to cancel.
  • Your MHF Transformation membership shall start from the date of the paid subscription for the nominated term paid for.
  • Your membership will automatically renew at the end of your paid period however you can cancel at anytime.
  • If you cancel you are able to re-join at anytime and start where you left off. You will still have access to all the material you have already completed so if you want to back to the beginning you can. You will need to use the same email when you re-join.
  • To cancel your membership go to My Account and you can cancel under Membership Subscription.  If you cancel you will still be able to access all of the material until your paid period is complete. There are no refunds.
  • You acknowledge that participating in any physical activity and making life changes through the health guidance given can carry risk and you accept that responsibility and in no way hold Micah Lindsay-Brown, Micah Health and Fitness employees, contractors and other members responsible. Professional advice should be sought where necessary, in particular if you have special dietary needs, physical disabilities or health conditions.
  • Please be thoughtful. Your membership is for personal use and within in reason, use with a friend or family member in your dwelling. See terms and conditions for the implications of not adhering to this.
  • Every fortnight you will have access to new workout material. This will allow you 14 days to participate and improve in each release of workouts. Every alternating fortnight you will get a health coaching video which will allow you time to take action before the next release. There will be times this may change, and extra sessions may be released or delayed when it is required.

TERMS AND CONDITIONS of MICAH HEALTH AND FITNESS MEMBERSHIP:

  • All references to “Micah Health and Fitness”, “We”, or “Us” or “Our” are references to or include Micah Lindsay-Brown trading as Micah Health and Fitness, Micah Lindsay-Brown as the principal and founder of Micah Health and fitness, and any staff, contractors or other persons providing fitness workouts, health coaching or other authorized services for or on behalf of Micah Health and Fitness.
  • Users of Micah Health and Fitness are referred to below as “members”, “participants”, or “you” or “I” as the context requires.
  • The following sets out the terms and conditions for use of the Micah Health and Fitness website, You Tube Channel, facebook page, and the use of our pre-recorded fitness sessions health coaching and any live streaming of Micah Health and Fitness.
  • These terms and conditions are governed by the laws of New Zealand.
  • Signing up to the Micah Health and Fitness Membership or accessing and participating in our workouts, you agree to be personally bound by these Terms and Conditions, including any changes or modifications made to these Terms and Conditions from time to time, according to the laws of New Zealand, and you warrant that you are at least 18 years of age or have the permission of a parent or caregiver to participate in Micah Health and Fitness.
  1. WHAT THE MICAH HEALTH AND FITNESS MEMBERSHIP ENTITLES YOU TO:
    a. Upon accepting our terms and conditions of participation and paying the relevant membership fee, the participant shall be given membership access to the Micah Health and Fitness website, and if relevant the facebook page, and recorded fitness and health coaching sessions for the period covered by the membership fee, which shall start from the date of the paid subscription or for the nominated term paid for.
    b. Micah Lindsay-Brown, principal of Micah Health and Fitness, will (subject to the variations set out below) provide participants with recorded fitness and health coaching sessions each week fortnight or month in accordance with the schedule. Additional fitness or health coaching  sessions may be provided at any time at the sole discretion of Micah Health and Fitness.
  2. VARIATIONS TO SCHEDULED HEALTH COACHING AND EXERCISE SESSIONS:
    a. In the unlikely event of illness or injury, Micah Health and Fitness will use all best endeavors to arrange for an experienced substitute to provide recorded fitness and health coaching in substitution for Micah Lindsay-Brown.
    b. If for any reason the minimum number of fitness sessions cannot be provided in any month, Micah Health and Fitness reserves the right to substitute a session with a pre-recorded earlier fitness session.
    c. While all efforts will be made to ensure fitness and health coaching sessions will be released at the correct time, technical difficulties or internet connection issues may at times mean that sessions my be released later than the published time.
    d. Micah Health and Fitness reserves the right to amend the scheduled release of all sessions.
  3. CONDITIONS OF PARTICIPATION IN MICAH HEALTH AND FITNESS WORKOUTS:
    By participating in Micah Health and Fitness workouts or in discussions between us and you, or generally among Micah Health and Fitness members, you expressly acknowledge and accept that:
    a. Micah Lindsay-Brown, principal of Micah Health and Fitness is a Personal Trainer and Health Coach, but not a nutritionist or medical practitioner, and does not hold herself or any other person participating in Micah Health and Fitness to have qualifications in these areas.  Guidance will be provided by Micah Health and Fitness in forums and through recorded videos on health and fitness. You acknowledge that participating in any physical activity and making life changes through health advice can carry risk and you accept that responsibility and in no way hold Micah Lindsay-Brown, Micah Health and Fitness employees, contractors and other members responsible. Micah Health and Fitness does not purport to endorse the comments or advice of other members or its accuracy or completeness. Professional advice should be sought where necessary, in particular if you have special dietary needs, physical disabilities or health conditions.
    b. The fitness workouts provided by Micah Health and Fitness include strength, mobility and at times HIIT (High Intensity Interval Training). You are solely responsible for ensuring you have a sufficient degree of fitness and physical capability to participate in this exercise format, and/or to seek professional advice from a medical professional if you are unsure.
    c. Participants who are inexperienced in strength, mobility or HIIT or who are beginning with a low level of personal fitness are encouraged and recommended to start use low options or get a personal training session with Micah or Greg Lindsay-Brown or other qualified trainers.
    d. Members who are pregnant or at post-partum stage participate in Micah Health and Fitness fitness workouts at their own risk. it is recommended that such members should seek professional medical advice and exercise clearance before participating in Micah Health and Fitness workouts, including pregnancy specific fitness workouts. While some general guidance or discussion may be provided in pregnancy workouts, you accept that Micah Lindsay-Brown, Micah Health and Fitness, employees or contractors, and other members are not responsible for the risks of training with these conditions. Micah Health and Fitness does not purport to endorse the comments or advice of other members or its accuracy or completeness. Professional advice should be sought where necessary, particularly if you are pregnant or post-partum.
    e. Micah Health and Fitness does not provide any warranties or guarantees as to any specific result from participation in workouts or health coaching sessions.
    f. If experiencing any unusual pain or discomfort during any Micah Health and Fitness workout sessions participants should cease the workout and seek advice from a medical professional or physiotherapist before continuing with Micah Health and Fitness workouts.
    g. Micah Lindsay-Brown and Micah Health and Fitness shall not be legally responsible for or bear any legal liability for any harm or injury suffered by any participant as a result of their participation in Micah Health and Fitness fitness workouts or health coaching sessions, and shall not accept any claim for compensation or reimbursement of medical costs associated with this.
    h. To the extent any other legal claim is otherwise permitted by law and is established against us, our total liability in respect of all claims in connection with any services provided by Micah Health and Fitness shall be limited to the total sum of any membership fees paid by you that relate to the cause of action established.
    i. You shall be bound by and observe the conditions and restrictions of use or sharing of Micah Health and Fitness workouts and health coaching and associated intellectual property as set out in Clause
  4. CONDITIONS OF, AND RESTRICTIONS AGAINST, USE OR SHARING OF MICAH HEALTH AND FITNESS WORKOUTS AND HEALTH COACHING AND ASSOCIATED INTELLECTUAL PROPERTY
    a. The name “Micah Health and Fitness”, The “Micah Health and Fitness” Logo, and all live streamed or uploaded recordings of workout and health coaching videos produced by Micah Health and Fitness are the intellectual property of Micah Lindsay-Brown trading as Micah Health and Fitness and may not be used in any manner that constitutes a breach of our intellectual property rights, unless expressly permitted by Micah Health and Fitness.
    b. All Micah Health and Fitness live or pre-recorded workouts and health coaching are for your personal use. Micah Health and Fitness authorises within the meaning of personal use, sharing and participating in Micah Health and Fitness workouts with other members of your immediate family or, within reasonable limits, sharing and participating in Micah Health and Fitness workouts with friends who are present with you at a private residential dwelling, for the purposes of participating in a workout or health coaching session with you.  Personal use does not include broadcasting or sharing the workout among large groups or public audiences, or in any online group or forum whether public or private, unless you have the express prior written consent of Micah Health and Fitness.
    c. You must not use, share, post or re-post Micah Health and Fitness material in connection with, or to promote, other services or products in any other forum, whether online or otherwise, without the express written permission of Micah Health and Fitness.
  5. PRIVACY AND MARKETING
    a. Micah Health and Fitness is video fitness and health coaching platform, website and Facebook page, with workouts and coaching sessions being uploaded to you tube. By participating in Micah Health and Fitness, you accept that any comments or posts you make may be visible to all members of Micah Health and Fitness. Because of the way in which facebook posts are published, you also accept that your comments may be visible to other facebook users outside of the Micah Health and Fitness group.
    b. You accept that Micah Health and Fitness may re-post Micah Health and Fitness workouts or health coaching sessions or forums online in order to promote and encourage others to join, and that this shall not constitute a breach of your privacy by Micah Health and Fitness.
    c. Micah Health and Fitness will use all reasonable endeavors outside of the circumstances in 5.a and 5.b to respect your individual privacy.  Should we wish to use any specific information about you, including posts about your personal experience in Micah Health and Fitness, or photos you publish in Micah Health and Fitness as part of any wider online promotional or marketing activities, we will seek your permission.
    d. Members and third parties are not permitted to advertise or promote their products or services on Micah Health and Fitness forums without the express written consent of Micah Health and Fitness.
  6. CANCELLATION AND REFUNDS:
    If you decide to cancel your membership, you expressly acknowledge and accept that:
    a. To cancel you membership go to My Account and you can cancel under Membership Subscription.  If you cancel you will still be able to access all of the material until your paid period is complete. There are no refunds.
    We may cancel your membership with immediate effect, if:
    b. You breach any part of clause 4; or
    c. You otherwise breach the terms and conditions of membership or commit an act that brings, or could bring the reputation of Micah Health and Fitness into disrepute.
    In the event we cancel your membership in accordance with these terms and conditions, refunds will be at the sole discretion of Micah Health and Fitness.

I first saw Micah with sore Achilles, which prevented me from running.Micah incorporated strength exercises that focused on balancing out my body. Within three months the Achilles pain had gone and it has never returned. I have been running 5-10kms 2-3 times a week ever since.

She also discovered my blood pressure was incredibly high! We quickly identified liquorice as the main culprit, but caffeine, lack of sleep and sugar were not helping. We Applied various strategies and after years of getting up anywhere between 2am and 4am most days and starting work, I now sleep incredibly well with a much improved life balance.

After a short time training I was able to loose those pesky 3-5 kilos that can make you feel blah. My limbs have far more tone now and visceral fat has decreased 25%!

Micah gave me the confidence to handstand against the wall (I’m 55), balance on my knees on a Swiss Ball while performing arm exercises and perform various routines on a Bosu Ball.

The workouts Micah designs for me feed my inner acrobat and make me think, practice balance and improve coordination.

For someone who thought they already ate a good diet I now don’t have caffeine, bread, white potatoes or rice, and have cut sugar significantly while the vegetable quota has at least doubled.

After all this time, I still love my sessions with Micah and enjoy doing the workouts she sets for me. Every session she checks where I’m at mentally, emotional and physically, and we work on making incremental improvements every time.

I’m not what you might call an avid gym goer. Working as a doctor with long hours. The last thing I want after a busy day is to put my body through more stress. But as a health professional I knew the importance of having a healthy lifestyle.

So I needed the motivation and drive to change my life. I knew doing it alone was going to be tough and it would be long before I actually found results. Micah is a fantastic personal trainer! Gem and I were heading overseas and wanted to get fitter and loose a bit of weight. We quickly found Micah to be excellent – she always challenges us but keeps things fun as well, she listens and works with us both as individuals and as a couple, she is professional and conscientious, she is always looking at new health and fitness ideas and how they might benefit us, she maintains good communication, and is a great friend! Micah takes a holistic approach to fitness - combining gym workouts with helping us improve our diet, sleeping habits, reducing stress, and getting us to focus on being happy.

Gem and I are at quite different fitness and strength levels, we have quite different fitness goals, and we approach the workouts quite differently. I have wanted to focus on general fitness and more cardio based workouts whereas Gem really likes the balance and confidence based workouts. Neither Gem or I are serious athletes but we have both seen great benefits in working with Micah on top of just increased fitness. Gem’s balance and her overall confidence has greatly increased. I am a competitive shooter and my work can be quite stressful – the gym, and working with Micah, has helped me become a better shooter and also helps me better release stress.

Through online health coaching with Micah I experienced more balance in my eating and could see the patterns I needed to look at. The coaching was very tailored to my health questions and the 'small steps' approach made it easier to manage the changes.
